Agreement

These Terms of Service ("Terms") are an agreement between you and Orbital Payload ("Orbital Payload," "we," "us," or "our"). They govern your access to and use of orbitalpayload.com, Orbital Payload, and related websites, APIs, accounts, multiplayer zones, features, content, and services (collectively, the "Service").

By using the Service, creating or claiming an account, signing in with a provider, submitting content, or playing Orbital Payload, you agree to these Terms and to the Privacy Policy. If you do not agree, do not use the Service.

The Service

Orbital Payload is a browser-based spaceport docking game in active development. The Service includes training, pilot accounts, multiplayer zones, WebSocket presence, docking runs, cargo systems, leaderboards, feedback, market and inventory systems, virtual credits, fuel systems, cockpit customization, billboard art, uploaded cockpit panel assets, and related experiments. Features may change, break, reset, or disappear as development continues.

Eligibility

You must be at least 13 years old to use the Service. If you are under the age of majority where you live, you may use the Service only with permission from a parent or legal guardian who agrees to these Terms. You may not use the Service if applicable law prohibits you from doing so.

Accounts And Security

Some features require a pilot account or authenticated session. You must provide accurate account information and keep it current. You are responsible for activity that occurs through your account, browser session, connected login provider, or device.

Keep passwords, login links, OAuth sessions, claim tokens, and browser sessions secure. Tell us promptly if you believe your account or session has been compromised. We may suspend, disable, limit, or revoke accounts or sessions when we believe it is necessary to protect pilots, the Service, or other users.

Acceptable Use

  • Do not use Orbital Payload to harass, threaten, exploit, or harm another person.
  • Do not submit feedback, billboard art, names, uploaded images, or other content that is unlawful, abusive, hateful, sexually explicit, invasive of privacy, or infringing.
  • Do not upload malware, secrets, credentials, private personal data, or content you do not have the right to use.
  • Do not cheat, automate play, tamper with telemetry, evade rate limits, overload the service, attack the network, scrape non-public data, or interfere with other pilots.
  • Do not try to access accounts, sessions, systems, data, admin tools, storage buckets, APIs, or zones that you are not allowed to access.
  • Do not sell, rent, transfer, or sublicense your account, pilot identity, virtual items, credits, or access to Orbital Payload without our written permission.

User Content

  • You keep ownership of content you submit, subject to the rights you grant us in these Terms.
  • You grant Orbital Payload a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify for technical formatting, display, perform, distribute, and use your submitted content to operate, promote, protect, and improve Orbital Payload.
  • Public or shared content, including leaderboard entries, feedback, billboard art, pilot names, and live presence, may be visible to other users or site visitors.
  • We may remove, hide, moderate, or restrict content when we believe it violates these Terms, creates legal or safety risk, harms the service, or degrades the experience.

Virtual Credits And Game Items

  • Credits, wallets, fuel, licenses, cargo rewards, inventory, upgrades, loadouts, cosmetics, billboard placements, and similar game state are limited-use virtual features for Orbital Payload only.
  • Virtual items and credits have no cash value, are not money, are not property, and are not redeemable, refundable, or transferable outside Orbital Payload unless we expressly say otherwise in writing.
  • We may add, change, rebalance, suspend, revoke, or discontinue virtual items, prices, rewards, and gameplay systems as the service evolves.
  • If real-money purchases are introduced later, additional purchase terms may apply before you buy.

Leaderboards, Gameplay Integrity, And Shared Zones

Leaderboards, cargo records, wallet ledgers, fuel events, market purchases, and shared zone state depend on client and server data. We may verify, reject, adjust, remove, or annotate records that appear corrupted, duplicated, abusive, impossible, fraudulent, or inconsistent with service rules.

Multiplayer zones are shared spaces. Other pilots may see your handle, display name, ship position, status, cargo activity, billboard art, and other gameplay state. Do not rely on any zone, leaderboard, reward, route, price, or virtual item being permanent.

Third-Party Services

The Service uses third-party services, including Cloudflare for hosting, database, storage, security, and network delivery, PostHog for analytics and diagnostics, and Google or Discord when you choose those login methods. Third-party services are governed by their own terms and policies. We are not responsible for third-party services that we do not control.

Ownership

Orbital Payload, including the game, code, artwork, brands, fictional companies, logos, UI, audio, gameplay systems, text, documentation, and related materials, is owned by Orbital Payload or its licensors and is protected by intellectual property and other laws. These Terms do not transfer ownership of the Service to you. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for personal, non-commercial play and evaluation.

Feedback

If you send suggestions, bug reports, feature ideas, or other feedback, you grant us the right to use it without restriction or compensation. Do not send confidential information in feedback.

Suspension And Termination

You may stop using the Service at any time. We may suspend, limit, disable, or terminate access to the Service or any account, session, content, virtual item, or feature at any time if we believe you violated these Terms, created legal or security risk, interfered with the Service, or harmed other users. Sections that by their nature should survive termination will survive, including ownership, user content licenses, disclaimers, limitations of liability, indemnity, and dispute terms.

Disclaimers

The Service is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, and uninterrupted or error-free operation. We do not guarantee that accounts, data, leaderboards, zones, uploaded assets, virtual items, or gameplay progress will always be available, accurate, preserved, or recoverable.

Limitation Of Liability

To the maximum extent permitted by law, Orbital Payload and its owners, operators, employees, contractors, agents, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost goodwill, service interruption, security incidents, or loss of virtual items, even if we have been advised of the possibility of those damages. To the maximum extent permitted by law, our total liability for all claims related to the Service will not exceed the greater of 100 US dollars or the amount you paid us directly for the Service in the 12 months before the claim.

Indemnity

You agree to defend, indemnify, and hold harmless Orbital Payload and its owners, operators, employees, contractors, agents, licensors, and service providers from claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising from your use of the Service, your content, your violation of these Terms, or your violation of law or third-party rights.

Changes To The Service Or Terms

We may change, suspend, or discontinue any part of the Service at any time. We may also update these Terms. The updated Terms will be posted on this page with a new last-updated date. Continued use of the Service after an update means you accept the updated Terms for later use.

Governing Law

These Terms are governed by the laws of the Commonwealth of Virginia and applicable United States law, without regard to conflict of law rules. Courts located in Virginia will have exclusive jurisdiction over disputes that are not required to be handled elsewhere by applicable law.
